Competiscan
These Terms of Service (“Terms”) govern access to and use of
the Competiscan MCP server (the “Service”) — the Model
Context Protocol interface that exposes Competiscan’s direct mail
archive as tools (search_campaigns, read_piece,
show_pieces, discover_filters) to Claude and
other MCP clients. By
accessing or using the Service, you agree to these Terms.
The Service is available only to authorized users of Competiscan LLC (“Competiscan,” “we,” or “us”) acting under an active Competiscan subscription. There is no self-service sign-up: accounts are provisioned by Competiscan and linked to a Competiscan sign-in or an API key issued through your account portal. You are responsible for all activity under your account and must notify us promptly at mcp@ai.competiscan.com if you believe your credentials have been compromised.

These Terms describe how the Service itself may be used. Fees, service tier, monthly quota, term, and renewal are set out in your organization’s separate Competiscan subscription agreement, which governs where the two documents conflict. If you are using the Service without such an agreement in place, that use is not authorized.
Our AI Privacy Policy describes what information we collect through the Service and how we use it, and supplements Competiscan’s general Privacy Policy, which governs the archive data itself. Both are incorporated into these Terms by reference.
The Service is designed to be called by Claude and other Model Context Protocol clients, including AI agents that decide on your behalf which tool calls to make. Competiscan is not responsible for the behavior, output, or decisions of any third-party client or AI model that connects to the Service — you remain responsible for how it is used under your account.
Competiscan retains all rights, title, and interest in the Service and the underlying archive, including all campaign records, images, OCR text, and derived data. Nothing in these Terms transfers ownership of that archive to you. You may use data returned by the Service internally within your organization for the purposes permitted by your subscription agreement.
The Service is provided “as is” and “as available.” The archive is built from a panelist network and reflects an extensive sample of United States and Canadian marketing activity, not a complete census of every piece mailed — we do not warrant that results are exhaustive, error-free, or uninterrupted. To the fullest extent permitted by law, Competiscan disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Competiscan will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the Service. Competiscan’s total liability arising out of or relating to the Service will not exceed the amount you paid Competiscan for the Service in the twelve months preceding the claim.
We may suspend or revoke access to the Service — including rotating or disabling an API key — if we reasonably believe your account is being used in violation of these Terms, poses a security risk, or if your underlying subscription lapses or is terminated. You may stop using the Service at any time; ending your subscription is handled under your subscription agreement.
We may update these Terms from time to time. Material changes will be posted on this page with an updated “last updated” date, and where appropriate, communicated by email. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles.
